Terms of Service

Version française

By accessing or using Yapademy, you agree to be bound by these Terms of Service (“Terms”), which also constitute our general terms of sale (conditions generales de vente). If you do not agree, do not use the service.

Yapademy is operated by YapLabs, a sole proprietorship (entreprise individuelle) registered in France (“we”, “us”, “our”). Registration details, address and contact information are in the Legal Notice at the bottom of this page. Contact: legal@yapademy.com.

1. Service Description

Yapademy is an AI-powered educational platform that lets you generate interactive tutorials on any topic. The service includes:

  • Tutorial generation using cloud-based AI models
  • On-device AI chat powered by a local language model running entirely on your device
  • Interactive simulations, diagrams, and exercises within tutorials
  • Quiz generation using on-device AI

2. Eligibility

You must be at least 15 years old to use Yapademy (the age of digital consent in France). By creating an account, you confirm that you meet this requirement and that all information you provide is accurate.

3. Accounts

To use most features you must sign in via a supported authentication provider (e.g., Google). You are responsible for all activity under your account and for keeping your credentials secure. Notify us immediately if you suspect unauthorized access.

4. Subscriptions and Payments

4.1 Free Tier

Free accounts may receive initial lesson credits at signup. On-device AI features, including chat, narration, speech input, and quiz generation, are unlimited once the required models are downloaded.

4.2 Paid Plans and Prices

Paid offerings are (a) Pro subscriptions (monthly or annual) that include a monthly allowance of lesson credits, and (b) one-time lesson packs that never expire. All prices are displayed inclusive of VAT and all taxes (TTC) before purchase. Subscription fees are charged in advance on a recurring basis and renew automatically until cancelled.

Payments are processed by Stripe, acting as merchant of record for the transaction: Stripe collects payment, applies and remits applicable VAT and sales taxes, and handles payment disputes. Your contract for the service itself remains with us.

4.3 Right of Withdrawal (droit de retractation)

As an EU consumer you normally have 14 days from the conclusion of a distance contract to withdraw without giving a reason (art. L221-18 of the French Consumer Code). For Yapademy purchases:

  • Lesson packs and tutorial generation are digital content supplied immediately. At checkout you are asked to expressly consent to immediate delivery and to acknowledge that you thereby lose your right of withdrawal (art. L221-28 13). Once supplied, these purchases are non-refundable under the withdrawal right.
  • Pro subscriptions are a digital service that starts immediately at your request. You keep your 14-day right of withdrawal. If you exercise it, you are refunded the price minus a proportional amount for the service already provided (for example, lesson credits consumed) up to the moment you notified us (art. L221-25).

To withdraw, use the online withdrawal form or email support@yapademy.com with an unambiguous statement. We will acknowledge receipt on a durable medium and refund within 14 days using the original payment method.

After the withdrawal period, refunds are evaluated case by case. Contact support@yapademy.com.

4.4 Cancellation

You may cancel your subscription at any time, free of charge, directly from the app: open the pricing screen and use “Manage or cancel subscription” (Stripe customer portal), or contact support@yapademy.com. Cancellation takes effect at the end of the current billing period and you keep access until then. No partial refunds are given for unused time outside the withdrawal cases described in 4.3. Unused purchased lesson packs survive cancellation.

Independently of any commercial policy, you benefit from the legal guarantee of conformity for digital content and digital services (art. L224-25-12 and following of the French Consumer Code) and the guarantee against hidden defects. If the service does not conform, you may request that it be brought into conformity, and failing that, a price reduction or termination of the contract, without charge.

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose
  • Attempt to circumvent usage limits or access controls
  • Reverse engineer, decompile, or extract our AI models or software
  • Use automated tools (bots, scrapers) to access the service
  • Generate content that is harmful, abusive, or violates third-party rights
  • Interfere with the operation or security of the service

6. Intellectual Property

6.1 Your Content

Tutorials generated for you are yours to use for personal and educational purposes. You retain rights to any content you create or input.

6.2 Our Property

The platform, including its software, AI models, design, and underlying technology, remains our exclusive property. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the service.

6.3 Feedback

If you provide suggestions or feedback about the service, we may use it freely to improve Yapademy without obligation to you.

7. On-Device AI

The local AI model runs entirely on your device. We do not receive, store, or have access to your chat conversations, quiz interactions, or any data processed by the on-device model. You are responsible for reviewing and using AI-generated outputs at your own discretion.

8. AI Disclaimer

Yapademy uses artificial intelligence to generate tutorials and educational content. AI-generated content may contain inaccuracies or errors. We do not guarantee the correctness, completeness, or suitability of any generated content. You are solely responsible for verifying and using such content.

9. Third-Party Services

The service integrates with third-party providers for authentication, payments, and hosting. Your use of those services is subject to their own terms. See our Subprocessors page for details.

10. Limitation of Liability

To the fullest extent permitted by law, Yapademy is provided “as is” without warranties of any kind, express or implied. Nothing in these Terms limits or excludes the legal guarantees and rights that consumers hold under mandatory French and EU law (including sections 4.3 and 4.5), or our liability for gross negligence, willful misconduct, or personal injury.

Subject to the above, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability to you for any claim will not exceed the amount you paid us in the 12 months before the claim arose, or 50 EUR, whichever is greater.

11. Data Protection

We comply with the General Data Protection Regulation (GDPR) and applicable French data protection laws. For details on how we handle your data, see our Privacy Policy.

12. Termination

We may suspend or terminate your access if you violate these Terms or for any reason with reasonable notice. You may delete your account at any time. Upon termination, your license to use the service ends immediately. Sections on intellectual property, liability, and dispute resolution survive termination.

13. Changes to Terms

We may update these Terms by posting a revised version. Material changes take effect 14 days after posting. Continued use after that date constitutes acceptance. If you disagree, stop using the service.

14. Consumer Mediation and Disputes

Mediation. In accordance with art. L612-1 of the French Consumer Code, if a written complaint to support@yapademy.com has not resolved your dispute, you may refer it free of charge to our consumer mediator:

[MEDIATOR NAME], [MEDIATOR POSTAL ADDRESS], [MEDIATOR WEBSITE]

The mediator can only be seized after a prior written complaint to us, and within one year of that complaint.

Governing law. These Terms are governed by the laws of France. Any disputes will be submitted to the competent courts, without prejudice to mandatory consumer jurisdiction rules and EU consumer protection provisions that apply in your country of residence.
